FAMILIARITY WITH THE BASIC RULES
- Entry
- These regulations specify: the rules for sending quotes, the conditions for placing orders, the rules for submitting complaints, the return of goods and the cancellation of orders.
- The owner of the Proton brand, the domain www.proton-stroje.pl and the services provided on behalf of Proton is Proton Tomasz Burdziński i Paweł Antczak spółka jawna with its registered office at ul. Szkółkarska 47 in Suchy Las, entered into the National Court Register maintained by the District Court for Poznań Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under the number 0000744565, and the Tax Identification Number (NIP) 9721293126
- All information about products and services provided on the website www.proton-stroje.pl, in particular their descriptions, parameters and prices, constitute only an invitation to conclude a contract, within the meaning of Article 71 of the Civil Code.
- Definitions:
- Product – a movable item offered for sale by Proton,
- Regulations – these regulations,
- Proton – seller – Proton Tomasz Burdziński and Paweł Antczak general partnership with its registered office at ul. Szkółkarska 47 in Suchy Las, entered into the National Court Register maintained by the District Court for Poznań Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under the number 0000744565, and the Tax Identification Number (NIP) 9721293126
- Customer – a natural person, a natural person running a business, a legal person or an organizational unit without legal personality that uses services provided electronically,
- Inquiry – a telephone call initiated by the Client or an email sent by the Client to the email addresses in the @proton-stroje.pl domain
- Order – a declaration of will by the Customer, constituting an offer to conclude a sales contract for a Proton Product,
- Sales Agreement – a Product sales agreement within the meaning of the provisions of the Act of 23 April 1964 – the Civil Code (Journal of Laws of 2014, item 121, as amended), concluded via an e-mail with an order sent to the e-mail addresses in the @proton-stroje.pl domain,
- The services provided electronically by Proton consist of:
- enabling the conclusion of a Sales Agreement by placing an order,
- contacting the Customer regarding the fulfillment of his order,
- informing the Customer about the progress of the order,
- placing orders for courier services to deliver the ordered Products.
- Rules for submitting quotes
- All quotes on behalf of Proton are sent exclusively from company mailboxes in the domain @proton-stroje.pl>/li>
- Proton provides free quotes for orders. After receiving a quote, the customer is under no obligation to use Proton's services. The quote is valid for 7 calendar days from the date of submission. This quote does not constitute an offer within the meaning of Article 66, Paragraph 1 of the Civil Code.
- Proton reserves the right to change the price of a given order from the price stated in the quotation. The customer must be informed of the reason for the price change and the price change before the order is processed. In such a case, the customer has the right to cancel the order.
- Terms and conditions of placing orders
- Proton's clients may only be legal entities, natural persons, individuals conducting business or professional activities, and organizational units without legal personality but with legal capacity.
- A Proton employee will begin processing the order when:
- The customer will send an e-mail, place an order via the online store or personally submit a full order with all the instructions, order details (including the size chart, selected clothing along with cuts, colors) and accept the design sent to him in electronic form
- The customer will make a full prepayment for the order, which will be credited to Proton's account. Order fulfillment will not be possible without meeting the above criteria.
- The completion date specified in the previous quote will be counted from the moment both points in paragraph 3.2 are met
- Proton shall not be liable for any delay in order fulfillment if the delay is no longer than 5 business days.
- Confirmation of placing and accepting the Order for execution will be sent to the Customer by Proton via e-mail.
- The sales contract is deemed to be concluded upon receipt by the Customer of the e-mail message referred to in point 3.5 of this paragraph.
- The customer is not entitled to cancel the placed order,
- Delivery of ordered goods or services is carried out by third-party courier companies. The courier company reserves the right to deliver the shipment on the third business day from the date of shipment by Proton, however, in most cases, shipments are delivered on the second business day from the date of shipment. Failure to deliver the shipment by the courier company on the second business day from the date of shipment does not entitle the customer to claim compensation or file a complaint. If additional paid courier options are selected (delivery by 10:00 AM, delivery by 12:00 PM, delivery on Saturday), the courier company reserves the right to refuse them without providing a reason, both before and after accepting the order. If the additional option is not fulfilled, the customer is only entitled to a refund of the additional option cost, without the possibility of claiming compensation or filing a complaint. Please take this into account when making your purchase.
- In the case of in-person pickup, the Customer agrees to collect the ordered goods within 5 business days of receiving confirmation that the order is available for collection (confirmation is sent via email). Orders not collected within the specified time will be returned at the Customer's expense to the address on the VAT invoice.
- The customer declares that they hold full copyright and property rights to the graphic design/logo they provide to Proton for printing or embroidery. Proton does not verify this declaration and always accepts it as true.
- Proton products are prefabricated items and in accordance with Article 38 of the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827), Customers are not entitled to return goods and recover costs.
- Pro forma invoices, receipts and VAT invoices are sent via e-mail to the address provided by the customer.
- The payment card operator is PayPro SA Settlement Agent, ul. Kanclerska 15, 60-327 Poznań, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under the KRS number 0000347935, Tax Identification Number (NIP) 7792369887, Regon 301345068
- Rules for submitting complaints
- Every customer has the right to file a complaint regarding an incorrectly completed order within 14 days of receiving the goods. To file a complaint, please send an email to biuro@proton-stroje.pl. The message must include a full description of the goods in question, a detailed description of the complaint, and photos documenting the incorrectly completed order.
- An order may be subject to a complaint only if:
- the deviation in size, color, weight and cut of the garment will be greater than +/- 5%, while the deviation in location, accuracy of pattern reproduction, color and size of the print will exceed the range of +/- 10%.
- the syntax of the product's graphic elements does not match the elements presented in the approved design, unless this applies to the product size selected by the customer.
The above restrictions result from the complicated production process.
- A response to customer complaints will be sent within 7 business days.
- The Customer Service Manager will decide whether the complaint will be accepted.
- The customer may only file a complaint regarding incorrectly printed or damaged promotional clothing. Any items that are not defective cannot be returned.
- If the Customer Service Manager approves the complaint, the product will be repaired. If repair is not possible, the terms of compensation will be determined individually (discount or reimbursement of costs incurred by the customer).
- Personal data protection
- By submitting an inquiry, the Customer consents to the processing of personal data by Proton, in accordance with the Personal Data Protection Act of 29 August 1997 (Journal of Laws of 1997 No. 133, item 883) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, i.e. GDPR).
- Personal data are processed by Proton solely for the purpose of providing the services referred to in § 1 point 1.5 of these Regulations.
- The customer has the option of accessing his or her personal data for the purpose of verifying, modifying or deleting it from Proton's database.
- Detailed information on the protection of the Customer's personal data can be found in the Privacy Policy document available on the website www.proton-stroje.pl
- Copyright protection
- All photos of the Products and other materials (including texts, graphics, logos) posted on the website www.proton-stroje.pl are the property of Proton or have been used by it with the consent of third parties who hold copyrights thereto.
- It is prohibited to copy photos and other graphic materials or reprint texts published on the website www.proton-stroje.pl, including making them available on the Internet, without the written consent of Proton or another third party holding the copyright thereto.
- It is also prohibited for external entities to download photos from the website www.proton-stroje.pl and use them for marketing and commercial purposes.
- The use of the above-mentioned materials without the written consent of Proton or other third party copyright holder is unlawful and may constitute grounds for initiating civil and criminal proceedings against those who commit such practice.
- Final provisions
- Before submitting an inquiry, the Client is asked to review the above Terms and Conditions. Submitting an inquiry to Proton constitutes the Client's acceptance of the Terms and Conditions.
- The Regulations are available on the website at: www.proton-stroje.pl/regulamin.html . Upon customer request, the Regulations will be sent by email. Amendments will take effect at the time expressly indicated by Proton, but no earlier than 7 business days after their announcement. Orders placed before the changes referred to in the previous sentence take effect will be fulfilled under the terms in force at the time of their submission.
- Customers will be informed about changes to the above Regulations on the Regulations website at: www.proton-stroje.pl/regulamin.html, where the date of the last modification of the regulations will be visible.
- Any disputes will be resolved by the competent court in Poznań, where Proton is headquartered.
